Floww 源穴 Terms of Service

Last Updated: March 30, 2025

1. Acceptance of Terms

These Terms of Service (“Terms”) are a legally binding agreement between you (“you” or “the client”) and Healthy Delight International Limited, the company operating Floww 源穴 (referred to as “Floww,” “we,” or “us”). By accessing our website (including floww.com.hk) or by visiting our wellness center and using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must refrain from using our website or services.

These Terms should be read in conjunction with our Privacy Policy. By agreeing to these Terms, you also consent to the data practices described in our Privacy Policy. Our services and website are intended for users in Hong Kong, and operations are limited to Hong Kong. You represent that you are at least 18 years old (or the age of legal majority in your jurisdiction) or, if you are under 18, that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Services Offered

Floww 源穴 is a wellness brand providing a range of holistic health and relaxation services in Hong Kong. Our offerings include, but are not limited to, the following:

  • Massage Therapy: Various massage treatments for relaxation, therapeutic relief, and wellness (e.g., aromatherapy massage, deep tissue massage, acupressure).
  • Wellness Treatments: Other wellness services such as stretching sessions, electrotherapy, and similar therapeutic treatments.
  • Consultations: One-on-one wellness consultations and guidance (for example, health assessments or lifestyle consultations) provided by our qualified staff.
  • Workshops and Classes: Wellness workshops, seminars, and group classes aimed at education and improving well-being.

All services are provided at our Hong Kong location and are subject to availability and these Terms. We continually strive to improve our offerings and reserve the right to modify or discontinue any service (see Modifications to Services or Terms below). Any additional guidelines or terms communicated to you (such as during a specific workshop or treatment) are considered part of our service terms. Please note that our services are currently available exclusively in Hong Kong, and any information on our website about services is intended for customers within Hong Kong.

3. Bookings

Clients may book appointments for Floww’s services through our website, by telephone, or in person as a walk-in. By making a booking, you agree to abide by our booking and cancellation policies outlined in these Terms. The following conditions apply to appointments and bookings:

  • Appointment Scheduling: We highly recommend booking appointments in advance to secure your preferred service, therapist, and time slot. Bookings can be made via our website’s online booking system, by calling our center, or by visiting us in person. Walk-in appointments are welcome on a first-come, first-served basis and are subject to availability.
  • Booking Confirmation: Once you request an appointment, we will confirm availability. A booking is not final until you receive a confirmation (for example, a confirmation page, email, or verbal confirmation over the phone) from us. Please review your confirmation details (date, time, service) and contact us promptly if any corrections are needed.
  • Contact Information: You must provide accurate contact information (such as your name, phone number, and/or email) when booking so we can reach you with any updates or reminders. If any of your contact details change, please inform us to ensure we can communicate about your appointment.
  • Securing a Booking: We reserve the right to require a credit card number or a deposit to hold certain bookings (especially for longer sessions, group bookings, or peak times). If a deposit is required, you will be informed at the time of booking of the amount and refund conditions. Any personal data collected for bookings will be used in accordance with our Privacy Policy.
  • Booking Changes: If you wish to make changes to your appointment (such as changing the time or type of service), please contact us as early as possible. Changes are subject to availability and may be treated as a cancellation and rebooking in some cases (see Cancellations and No-Shows below for timing requirements).

Floww reserves the right to refuse or cancel any booking at our discretion. This may occur, for example, if a client has repeatedly violated our cancellation policy or Code of Conduct, or in rare cases of double-booking or errors. If we must cancel your appointment (due to therapist unavailability, emergency, or other unforeseen circumstances), we will make reasonable efforts to notify you as soon as possible and offer to reschedule or provide a refund for any pre-paid amount.

4. User Accounts

While our website currently allows booking without a user account, we may in the future offer the option to register a personal account for easier scheduling and access to additional features. The following terms apply to any user accounts on our website:

  • Account Registration: If account functionality is available, creating an account is optional and free. When you register, you agree to provide truthful, accurate, current, and complete information about yourself as prompted by the registration form. You may be asked to create a username and password.
  • Account Responsibility: You are responsible for maintaining the confidentiality of your account login credentials. You agree not to share your username or password with others and to restrict access to your account. Any activity that occurs under your account is your responsibility. If you suspect any unauthorized use of your account or a security breach, you must notify us immediately.
  • Account Usage: Accounts are for personal use only. You must not impersonate any other person or entity, or use someone else’s account at any time. You agree to use any website account and our website in compliance with these Terms and all applicable laws. This means you will not use the site for any fraudulent or unlawful purposes or engage in any behavior that could damage or impair the site’s functioning (such as introducing viruses or attempting to gain unauthorized access to our systems).
  • Account Termination: We reserve the right to suspend or terminate your user account at our discretion if we believe you have violated these Terms, provided false information, or engaged in misconduct. We may also terminate accounts that have been inactive for an extended period or for other operational reasons. If we terminate your account, we may revoke your ability to use the website’s account-only features, but these Terms will continue to apply to any past use of the site or services.
  • Future Features: As our services evolve, we may introduce new features that require an account (such as loyalty programs, purchase history tracking, or online gift card management). Any such features will be governed by these Terms and possibly additional terms that will be communicated to you. By opting to use those features, you agree to any additional applicable terms.

Please note that you do not need an account to simply browse our website or call our center for inquiries. If you choose not to create an account, you can still book appointments via phone or as a guest on our website.

5. Gift Cards, Packages, and Promotions

Floww 源穴 may offer gift cards, prepaid packages, and special promotional offers to provide value and convenience to our clients. These are subject to specific terms as outlined below:

  • Gift Cards: We may issue physical or electronic gift cards or certificates for purchase. Gift cards can typically be redeemed by the holder for services at Floww. Gift cards are not redeemable for cash (except as required by law) and are non-refundable once purchased. Each gift card may carry an expiration date as permitted by Hong Kong law, which will be indicated at the time of purchase or on the card itself. After the expiration date, any unused balance may be forfeited. Non-transferability: Gift cards should be treated like cash – anyone in possession of the card or code can use it, so please keep it secure. We are not responsible for lost, stolen, or unauthorized use of gift cards. If you have a gift card, check any additional terms provided with it or on our website (such as whether it can be used in multiple visits or only once, etc.). By using a Floww gift card, you agree to these Terms and any terms printed on the card or accompanying materials.
  • Prepaid Packages: From time to time, we may offer packages (for example, a bundle of multiple sessions or a membership program) at special rates. Packages often provide a number of sessions or services for a single upfront payment (e.g., 5 massage sessions at a discounted price). Validity and Expiry: Packages may have a validity period (for instance, usable for 6 or 12 months from purchase). Any unused sessions after the expiry date may be forfeited and will not be refunded. Non-Transferability: Unless expressly stated otherwise, packages are intended for use by the purchaser or a designated beneficiary and cannot be transferred or shared among multiple people. (For example, you should not split a 5-session package between two different individuals, unless the package terms explicitly allow it.) Booking and Cancellation for Packages: When using a session from a package, you must still book your appointment and adhere to the same cancellation policies (see Section 6). A late cancellation or no-show may result in that session being deducted from your package as if it were used. Packages are non-refundable except at our discretion or if required by law (for example, in the event we cease providing a service included in your package, we may offer alternatives or partial refunds).
  • Promotions and Special Offers: We may run promotional deals, discounts, or loyalty programs (for example, a first-time client discount, seasonal promotions, referral rewards, etc.). All promotions are offered at our discretion and may be subject to additional terms and conditions which will be made available as part of the promotion (for example, on our website, marketing materials, or at the time of booking). Limited Time and Availability: Promotions often run for a limited period or have limited availability. We reserve the right to modify or withdraw any promotion at any time without advance notice (though this will not affect promotions you have already redeemed or purchased). Conditions: Promotions cannot typically be combined with other promotions or discounts unless explicitly stated. Some promotions may have eligibility requirements (e.g., “new customers only” or valid only on weekdays, etc.). If you redeem a promotion, you are responsible for understanding any applicable requirements. Any services booked under a promotional rate are still subject to our standard policies (for example, if you cancel late, you may lose the promotional eligibility or incur fees based on the non-discounted price). No Cash Value: Promotional coupons, credits, or vouchers have no cash value and are not redeemable for cash. Any suspected abuse of promotions (such as using multiple email addresses to claim an offer multiple times contrary to its terms) may result in the promotion being voided and/or your account or bookings being cancelled.

By purchasing or using any gift card, package, or promotion, you agree to these Terms and any specific terms of the offer. For any questions about using your gift card or package, or details of current promotions, please contact us (see Contact Information below).

6. Cancellations and No-Shows

We understand that plans can change, and we ask you to give us advance notice if you need to cancel or reschedule an appointment. Our cancellation policy is designed to respect your time and that of our therapists and other clients. By booking an appointment with Floww, you agree to the following cancellation and no-show terms:

  • Cancellation Notice: To avoid fees, you must cancel or reschedule your appointment at least 24 hours before your scheduled start time. You can cancel by calling us or using the designated method (if you booked online, you may cancel through the online system or as instructed in your confirmation).
  • Late Cancellations: If you cancel less than 24 hours before your appointment, this is considered a late cancellation. In the case of a late cancellation, we reserve the right to charge a cancellation fee. This fee may be up to 100% of the scheduled service price (plus any applicable taxes). If you paid in advance (or are using a prepaid package session), the payment may be applied toward this late cancellation fee and may not be refundable.
  • No-Shows: If you miss your appointment without any cancellation notice (“no-show”), we reserve the right to charge you the full price of the missed service. For prepaid packages or gift card bookings, the session may be deducted as if it were rendered. Repeated no-shows may result in us requiring prepayment for future bookings or, in extreme cases, refusing future service.
  • Late Arrivals: Please plan to arrive on time (or a few minutes early) for your appointment. If you arrive late, we will do our best to accommodate you, but your session may still end at the originally scheduled end time so that other clients are not inconvenienced. If you are more than 15 minutes late, we may deem you a no-show and shorten or cancel your session. In such cases, the full service fee may still apply. (If our schedule allows, we might continue with a full session despite a late start, but this cannot be guaranteed.)
  • How to Cancel: Cancellations should be made via the same channel you booked (e.g., if you booked by phone, call us to cancel; if you booked online, use the online cancellation feature or call if available). Leaving messages after hours will be considered received at the time of the next business day opening.
  • Emergency Exceptions: We understand that emergencies or unforeseen events happen. If you missed an appointment or canceled late due to a serious emergency or circumstance outside your control, please inform us. We may, at our discretion, waive cancellation fees or offer to reschedule without penalty in such cases. This is decided on a case-by-case basis and is not guaranteed.
  • Clinic Cancellations: In the rare event that Floww needs to cancel or reschedule your appointment (for example, due to therapist illness, unexpected closure, or other emergency), we will notify you as soon as possible. Any prepayments you made for the affected appointment will be applied to the rescheduled session or refunded if we cannot accommodate a reschedule. We will not charge cancellation fees for cancellations that we initiate, and we will make reasonable efforts to find an alternative appointment time for you.

By respecting this cancellation policy, you allow us to manage our therapists’ time effectively and possibly offer the slot to other clients on our waiting list. We appreciate your cooperation. Please note that when you provide your credit card information for booking, you are authorizing us to charge cancellation or no-show fees to that card according to the policy above.

7. Medical Disclaimer

Floww 源穴 provides wellness and therapeutic services aimed at relaxation, stress reduction, and general well-being. However, we are not a medical or healthcare provider, and our services are not a substitute for professional medical advice, diagnosis, or treatment. Please carefully note the following:

  • Not Medical Advice: Any information or suggestions provided by Floww staff (whether on our website, in promotional materials, or in person during a session or consultation) are for general wellness purposes only. They are not intended to constitute medical advice. Always seek the guidance of a qualified medical professional for any health-related questions or concerns you may have before, during, or after using our services.
  • No Medical Treatment: Our therapists and instructors are certified or trained in their respective wellness fields (such as massage therapy or fitness), but they are not medical doctors. They will not diagnose conditions, prescribe medications, or perform any medical treatments. The wellness services we offer (massage, stretching, etc.) should be pursued only if you are medically fit to do so. If you have any doubt about whether a service is appropriate for you due to a health condition, please consult your physician first.
  • Health Conditions – Client’s Responsibility: It is your responsibility to disclose any relevant health conditions prior to receiving a service. This includes but is not limited to: pregnancy, high or low blood pressure, heart conditions, recent surgeries or injuries, allergies (e.g., to oils or lotions), skin conditions, chronic illnesses, mobility limitations, or any other medical condition or physical issue that could affect or be affected by your treatment. We rely on you to provide complete and accurate health information so that we can safely tailor our services to your needs.
  • Right to Refuse or Modify Service: Based on the health information you provide, or if you exhibit signs of a condition that was not disclosed, our staff may recommend altering the service or, in some cases, politely refuse to perform the service if we believe it could pose a risk to your health. This is for your safety. For example, certain massage techniques might not be advisable in the first trimester of pregnancy or for someone with certain injuries. We may require a doctor’s note or consultation before proceeding with service for some medical conditions.
  • No Guarantees of Outcomes: While we strive to help you feel better and promote wellness, individual results can vary. We do not guarantee any specific outcome from our treatments (such as pain relief, improved health, etc.). You use our services with the understanding that there is no guaranteed benefit and that any benefit depends on your unique condition and how your body responds.
  • Client Assumption of Risk: By using our services, you acknowledge and accept the inherent risks that may come with wellness treatments (for example, temporary soreness after a deep tissue massage, or dizziness after a session). If at any time during a session you feel pain, discomfort, or something feels not right, you should immediately inform the therapist and/or stop the session. We will take appropriate measures, which may include stopping the treatment or adjusting techniques. Failing to communicate discomfort could result in avoidable injury, and we cannot be responsible for harm that could have been prevented with prompt feedback during the service.

In summary, always prioritize your health and consult a medical professional for any medical issues. Floww and its staff will do their best to provide a safe and enjoyable experience, but we are not liable for issues arising from undisclosed health conditions or from clients ignoring medical advice (see Limitation of Liability below for more on this). Your well-being is our priority, and we encourage open communication about any concerns before, during, and after your sessions.

8. Code of Conduct

We are committed to maintaining a tranquil, safe, and respectful environment for all clients and staff at Floww. By entering our premises or using our services, you agree to conduct yourself in a manner consistent with this Code of Conduct:

  • Respect and Courtesy: Treat all Floww staff members and other clients with respect, courtesy, and dignity. Harassment, abusive language, yelling, threats, or any form of disrespectful or aggressive behavior will not be tolerated.
  • Professional Boundaries: Our therapists and consultants are professionals. Any form of inappropriate behavior, including but not limited to sexual harassment (such as making sexual suggestions, innuendos, or advances toward our staff), is strictly prohibited. If a client behaves inappropriately, the session will be terminated immediately without refund, and the client may be prohibited from returning.
  • Privacy and Comfort: Respect the privacy and comfort of others at our facility. For example, keep noise to a minimum in relaxation areas, and refrain from using mobile phones or devices in a way that disturbs others. Taking photographs or videos of other clients or staff without permission is not allowed. We also ask that you follow any instructions given by staff regarding the use of lockers, draping with towels/sheets during massage for modesty, or other protocols that ensure everyone’s comfort.
  • Punctuality and Consideration: Arrive on time for your appointments (see Late Arrivals in the Cancellations section). Repeated tardiness or last-minute cancellations disrupt our schedule and may inconvenience others. As noted, chronic lateness or no-shows may lead to refusal of future bookings.
  • Sobriety and Safety: For the safety of all clients and staff, do not attend a session under the influence of alcohol or illicit drugs. If our staff reasonably suspects you are intoxicated or impaired, we reserve the right to refuse or discontinue service. This is both for your safety (certain treatments may be unsafe under influence) and to maintain a professional environment.
  • Facility Rules: While on our premises, please adhere to all posted signs and guidelines. This includes no smoking (our facility is smoke-free), no eating or drinking in treatment areas (unless provided as part of a service like a tea), and proper use of spa facilities if any (such as showers or steam rooms, if applicable). If you are unsure about how to use any equipment or have questions about facility rules, please ask a staff member for assistance.
  • Personal Belongings: You are responsible for your personal belongings during your visit. We advise leaving valuables at home. While we may provide lockers or storage for your convenience, Floww is not liable for lost, stolen, or damaged personal items on our premises (see Limitation of Liability). Please be respectful of common areas and keep them tidy for others.
  • Compliance with Law: You agree not to engage in any illegal activities on our premises or through our services. Any conduct that is illegal (such as use of illicit substances, theft, vandalism, or assault) will result in immediate expulsion from the premises and may be reported to the Hong Kong authorities.

Enforcement: Floww reserves the right to refuse service to anyone violating this Code of Conduct or any other provisions of these Terms. If your behavior is deemed inappropriate or disruptive, we may ask you to leave the premises immediately. Serious or repeated violations may result in a permanent ban from our facility and potentially involve law enforcement if laws are broken. In the case of such termination of service due to misconduct, you will still be responsible for full payment of any services rendered (or booked) and will not be entitled to any refund for services forfeited due to the misconduct.

Our goal is to create a peaceful and healing environment for everyone. We ask for your cooperation in upholding these standards of behavior. If at any time you feel that someone else is not adhering to these rules and it is affecting your experience, please inform a member of our staff and we will address the situation as appropriate.

9. Intellectual Property

All content and materials on the Floww 源穴 website and within our premises are protected by intellectual property laws and are the exclusive property of Healthy Delight International Limited or its content suppliers, unless otherwise indicated. Below are the key points regarding our intellectual property:

  • Website Content: The text, graphics, logos, button icons, images, audio clips, video clips, digital downloads, data compilations, and software on our website (collectively, the “Content”) are either the property of Healthy Delight International Limited (Floww) or are used by us with permission. This Content is protected by copyright laws and other intellectual property rights. All rights are reserved. You may not copy, reproduce, distribute, publish, display, perform, modify, create derivative works from, transmit, or otherwise exploit any Content from our website without our prior written consent, except for your own personal and non-commercial use (for example, printing a page of service descriptions for your personal reference is allowed, but using our text or images on your own website or marketing materials is not).
  • Trademarks and Branding: “Floww 源穴”, the Floww logo, and any slogans or service names we use are trademarks or service marks of Healthy Delight International Limited. These marks, along with all related graphics, logos, and trade dress (the look and feel of our website and materials), are protected by trademark laws. No license or right is granted to you to use any of these trademarks without our express written permission. Unauthorized use of our trademarks (including in meta tags or advertising) is strictly prohibited. Other trademarks that appear on our website or in our center (for example, the trademarks of product brands we use or retail) are the property of their respective owners and are used solely to identify those products or services.
  • User-Provided Content: If our website in the future allows you to post comments, reviews, or other content, or if you provide us with testimonials or feedback (collectively, “User Content”), you retain ownership of your content. However, by providing or posting it, you grant Floww a royalty-free, perpetual, irrevocable, worldwide, non-exclusive license to use, reproduce, modify, publish, translate, distribute, and display that content in any media (for example, posting your testimonial on our site or quoting your feedback in marketing). We would only use your content in line with our Privacy Policy (e.g., not revealing your personal information without consent). You also agree not to submit any content that infringes someone else’s intellectual property or other rights.
  • Limited License for Site Use: Floww grants you a limited, non-transferable, revocable license to access and make personal use of our website for the purposes of learning about our services, booking appointments, or other authorized functions. This license does not include any resale or commercial use of our site or its Content; any collection and use of any service listings, descriptions, or prices for commercial purposes; any derivative use of our site or Content; or any use of data mining, robots, or similar data gathering and extraction tools. You agree not to frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information of Floww without express written consent.
  • Intellectual Property Infringement: We respect the intellectual property rights of others, and we ask our users to do the same. If you believe that any content on our website infringes your copyright or other IP rights, please notify us with detailed information so we can investigate and address the issue appropriately. (You may send such concerns to our contact email provided in the Contact Information section.)

Any unauthorized use of the Content or our intellectual property may result in termination of the limited license granted by these Terms and may violate copyright, trademark, or other laws. We will take appropriate legal action to protect our rights if necessary.

10. Limitation of Liability

Please read this section carefully as it limits the liability of Floww and Healthy Delight International Limited and defines your remedies. We aim to provide a safe, high-quality service, but there are legal limits to what we can be held responsible for.

  • Use of Services and Website at Your Own Risk: You understand that using our wellness services and accessing our website is at your own risk. Our services are provided in good faith and we strive for excellence, but we do not make any specific guarantees about the results or outcomes of our services or the accuracy of information on our site. The website and all content therein are provided on an “as is” and “as available” basis without any warranty of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. For example, we do not warrant that the website will be uninterrupted or error-free, or that any particular wellness treatment will meet your expectations or health needs.
  • Limitation of Damages: To the fullest extent permitted under applicable law, Floww (Healthy Delight International Limited) and its directors, officers, employees, agents, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages whatsoever. This includes, without limitation, damages for loss of profits or revenue, loss of data, business interruption, personal injury, pain and suffering, emotional distress, or similar harms arising out of or in connection with (a) the use of or inability to use our website; (b) the use of or reliance on any content on the website; (c) the performance of any of our services or any products used in the course of our services; or (d) any other matter relating to our services or these Terms, even if we have been advised of the possibility of such damages.
  • Cap on Direct Damages: To the extent we are found liable for any claim, our aggregate liability to you (for any and all causes of action, whether in contract, tort, or otherwise) will not exceed the total amount actually paid by you to Floww for the specific service or product that gave rise to the liability. If the claim does not relate to a specific service or product (for example, a claim arising from use of the website alone where no purchase was made), then our liability shall not exceed a reasonable amount as determined by a court of competent jurisdiction. This limitation is cumulative and not per-incident; multiple claims will not increase this cap.
  • No Liability for Certain Events: Floww is not responsible or liable for any failure to perform, or delay in performance of, any of our obligations (such as providing a scheduled service) if such failure is caused by events beyond our reasonable control. This includes, but is not limited to, acts of God (like earthquakes or typhoons), government restrictions, strikes, pandemics or public health emergencies, power outages, internet or communications failures, or any other event that is beyond our reasonable control. However, we will make reasonable efforts to resume services as soon as practicable in such cases and will communicate with affected customers (for example, to reschedule appointments).
  • Personal Injury and Property: While we take precautions to ensure a safe environment, Floww is not liable for injuries or adverse reactions that occur during or after our services except to the extent such injury is caused by our gross negligence or willful misconduct. By receiving our services, you acknowledge the inherent risks (as discussed in the Medical Disclaimer) and agree, to the extent allowed by law, to waive and release us from any claims of injury or damage arising from services received, if those risks were disclosed to you or are inherent to the nature of the service. Additionally, as noted, we are not responsible for loss, theft, or damage to your personal belongings on our premises.
  • Website Security: We implement reasonable security measures for our website, but we do not guarantee that the site will be free from viruses, malware, or other harmful components. You are responsible for using up-to-date antivirus software on your own device. We will not be liable for any damage to or virus that may infect your computer equipment or other property due to your access to or use of our website or downloading of any material from the site.
  • Consumer Rights: We acknowledge that in some jurisdictions (including Hong Kong), certain warranties or liabilities cannot be excluded or limited by law. Nothing in these Terms is intended to exclude any liability that we are not allowed to exclude under law. If applicable law imposes non-excludable warranties or guarantees, we limit our liability to the minimum extent permitted by that law. For example, under Hong Kong law, our liability for personal injury or death resulting from our negligence cannot be excluded; in such cases, we do not seek to exclude that liability. Similarly, statutory rights under consumer protection laws are not affected by these Terms.
  • Advice and Information: Any advice or information (oral or written) that you obtain from Floww or through our services does not create any warranty or guarantee not expressly stated in these Terms. You should not rely on any oral representations if they conflict with these written Terms.

By using our website or services, you agree that the exclusions and limitations of liability set forth in this section are reasonable. If you do not agree that they are reasonable, you must not use the site or our services. This Limitation of Liability section shall survive the termination or expiration of these Terms and/or your use of our services.

11. Indemnity

You agree to indemnify, defend, and hold harmless Floww, Healthy Delight International Limited, and our respective directors, officers, employees, agents, contractors, and affiliates (collectively, the “Indemnified Parties”) from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) that arise out of or relate to:

  • Your Breach: Any breach of these Terms by you. For example, if you violate our cancellation policy or Code of Conduct and that violation causes us damage or expense, you agree to cover those costs.
  • Your Misuse of Services or Website: This includes any use of our services or website for purposes other than intended or permitted by these Terms. If you engage in any fraudulent, illegal, or unauthorized use of our website (such as hacking attempts, misuse of booking systems, or infringement of our intellectual property) or misuse our services (for instance, using them in contravention of medical advice or reselling our services without permission), you will be responsible for any costs or damages we incur as a result.
  • Damage or Injury: Any damage to property or injury to persons caused by you on our premises or in connection with our services, to the extent that such damage or injury is due to your negligent or willful acts or omissions. (For example, if you damage equipment due to misuse or you cause harm to a staff member or another client through inappropriate behavior, you may be held responsible.)
  • Your Content or Communications: If you provide any content (such as a review or feedback) or communicate with us or other clients in a way that violates any law or the rights of a third party (e.g., defames someone or violates privacy), and an Indemnified Party faces a claim because of it, you will indemnify us for that claim.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of such claim. You agree not to settle any such matter without the prior written consent of Healthy Delight International Limited.

Your indemnification obligation survives the termination of these Terms and your use of our services. This means even if you stop using the website or our services, you would still be responsible for costs arising from things that occurred during your use.

12. Modifications to Services or Terms

  • Changes to Services: Floww is continually evolving to best serve our clients. We reserve the right to change, expand, reduce, or discontinue any of our services or products at any time. This may include changing service descriptions, duration, pricing, operational hours, or the introduction of new services and discontinuation of existing ones. We may also rearrange our staff, change the location of our center (within Hong Kong), or make other operational changes. We will endeavor to provide notice of significant changes (for example, posting announcements in our center or on our website if we plan to discontinue a popular service or change our hours). However, all services are subject to availability, and offering a service at one time does not guarantee it will be available indefinitely.
  • Changes to Terms: We may revise or update these Terms of Service from time to time. If we make changes, we will post the updated Terms on our website with a new “Last Updated” date at the top. In some cases, if the changes are material and you have an account or an upcoming booking, we may notify you via email or through a notice on our site. It is your responsibility to review these Terms periodically for any updates. Your continued use of our website or services after any changes to the Terms constitutes your acceptance of the updated Terms.
  • Notice of Changes: If you do not agree with any changes to the Terms or to our services, you should notify us and cease using our services and website. For minor or routine updates to these Terms (such as clarifications or changes that do not reduce your rights), we may not provide individual notice, so please check the Terms on our site from time to time. For significant changes that might affect your rights or obligations, we will make reasonable efforts to inform you (for example, via the email associated with your account or via a prominent notice on our booking page).
  • Interim Agreements: If you have a specific package or agreement with us (for example, a prepaid series of sessions or a gift card purchased under certain terms), and we update these general Terms in a way that materially affects that arrangement, we will endeavor to honor the terms that were in place at the time of your purchase for the duration of that agreement. For instance, if you bought a package that promised certain benefits, we will honor those benefits for the life of that package, even if our Terms later change those offerings for new purchasers.
  • Technical Upgrades: We reserve the right to modify or update our website’s design, layout, functionality, or technical requirements. This may require you to update your own software or equipment (for example, using an updated browser) to continue using the website. We are not liable for your inability to access the website or make bookings due to your technology not meeting the new requirements.
  • Temporary Suspension: Occasionally, we might need to temporarily suspend the website or certain services for maintenance, upgrades, or emergency repairs. We will try to schedule maintenance during off-peak hours and provide advance notice when possible, but we reserve the right to suspend access without notice if necessary. During such periods, the Terms are still in effect as applicable.

By continuing to use Floww’s services and website, you agree to any changes implemented. If at any time you find the Terms unacceptable, or if you disagree with any changes we have made, you must refrain from using our website and services. Always feel free to contact us if you have questions or concerns about changes to our services or policies.

13. Third-Party Links

Our website and communications may include links to third-party websites or services (for example, partners, affiliates, booking platforms, or informative articles on wellness). Any such links are provided for your convenience or informational purposes only. Please note the following regarding third-party links:

  • No Endorsement or Control: The inclusion of a link to an external site does not imply that Floww endorses, approves, or controls that site or its content. We do not have control over third-party websites and are not responsible for the content, products, services, advertising, or other materials on or available from those sites.
  • Different Terms and Privacy: Third-party websites are governed by their own terms of use and privacy policies. When you click a link and leave our website, you should be aware that our Terms and Privacy Policy no longer apply. We encourage you to read the terms and conditions and privacy policy of any external site you visit through links from our site.
  • No Liability for Third-Party Interactions: If you choose to interact with any third-party through a link on our site (for example, if you purchase a product from a partner or book a service via a third-party booking engine, or even just rely on information provided on an external blog we linked to), any interaction is solely between you and that third party. Floww will not be responsible for any loss or damage of any sort incurred in connection with such dealings. This includes, but is not limited to, any payments you make to a third party, any personal data you provide to them, or any outcomes of engaging with their content or services.
  • Third-Party Content on Our Site: In some cases, our website might feature content provided by third parties (for example, testimonials, social media feeds, or embedded videos). Such content is the responsibility of the entity that provided it, and while we strive to ensure all content on our site is appropriate and accurate, we cannot guarantee the completeness or reliability of third-party provided content.
  • Links to Us: If a third-party site links to our website, it does not imply any formal association with that third party unless explicitly stated. We are not responsible for how third-party sites may represent or misrepresent their relationship with Floww.

In summary, when you follow links to external websites, you do so at your own risk. We provide these links as a convenience, and any issues arising from your interaction with a linked third-party site should be addressed to the operators of that site. If you have a bad experience with any third-party link we provide (such as a broken link or inappropriate content), feel free to contact us so we can consider removing or updating the link.

14. Governing Law and Dispute Resolution

This Agreement and any dispute or claim arising out of or in connection with these Terms, our services, or our website shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR), without regard to its conflict of law principles. By using our services or website, you agree to submit to the following provisions regarding legal disputes:

  • Jurisdiction: You and Floww (Healthy Delight International Limited) agree that any disputes shall fall under the exclusive jurisdiction of the courts of Hong Kong. This means that if you wish to bring a legal claim against us, or we against you, it will be handled in a court located in Hong Kong, and you consent to the exercise of jurisdiction by such courts. If you are accessing our services from outside Hong Kong (even though our operations are intended for Hong Kong only), you still agree that Hong Kong law applies and Hong Kong courts will adjudicate any disputes.
  • Dispute Resolution: In the event of any controversy or claim, we strongly encourage you to first contact us directly to seek an amicable resolution. Often, issues can be resolved quickly through our customer service without formal legal action. You can reach out as per the Contact Information section below, and we will attempt in good faith to address your concerns.
  • Mediation (Optional): If a dispute cannot be resolved informally, the parties may (by mutual agreement) attempt to resolve it through mediation or alternative dispute resolution in Hong Kong before proceeding to court. This is not mandatory, but it can be a faster and less expensive way to resolve disagreements. Any such mediation would be confidential and non-binding unless a settlement is reached.
  • Legal Proceedings: If litigation is pursued, these Terms will be admissible in court as a binding agreement between you and us. You agree that any claim or cause of action you have against Floww arising from or relating to these Terms or your use of the services must be brought within one (1) year after such claim or cause of action arises, otherwise it will be permanently barred. (This time limit is subject to any shorter limit that might be imposed by law for specific types of claims.)
  • Injunctive Relief: Notwithstanding the above, we reserve the right to seek injunctive or equitable relief in any jurisdiction if necessary to protect our intellectual property or confidential information (for example, if there is an infringement of our trademarks or an unauthorized disclosure of our trade secrets, we may need to act quickly in a relevant jurisdiction).
  • Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent such that the remainder of the Terms will continue in full force and effect. In other words, the invalid part will be severed, but the rest of the agreement remains binding.
  • No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If we do waive a default or breach of these Terms by you, that waiver is limited to the specific situation and does not mean we waive any later default or breach by you or anyone else.
  • Entire Agreement: These Terms (together with any other policies or guidelines we reference, such as our Privacy Policy and any specific terms for particular services or promotions) constitute the entire agreement between you and Healthy Delight International Limited (Floww) relating to your use of our website and services. It supersedes any prior agreements or communications (whether oral or written) between you and us regarding the same subject matter. You acknowledge that you have not relied on any representation, warranty, or statement that is not expressly set out in these Terms.
  • Third-Party Rights: A person who is not a party to these Terms (other than Healthy Delight International Limited and you) has no right under Hong Kong’s Contracts (Rights of Third Parties) Ordinance (Cap. 623) to enforce any term of this Agreement. This means only you and we have legal rights under this contract (except as otherwise provided in these Terms regarding our affiliates, etc. being protected by certain clauses like Indemnity and Limitation of Liability).

By agreeing to these Terms, you are explicitly agreeing that all aspects of your use of our services and website will be handled in accordance with Hong Kong law and through Hong Kong’s legal system, if necessary.
